Welcome to Gibson House LLC. By using our services, including our Marco SMS-based website management service, you agree to these Terms of Service. Please read them carefully.

1. Service Description

Gibson House provides various services including Marco, which offers website creation and management services via SMS. You text us your website updates, and we implement them for you. Our services include:

• Initial website setup and design
• Ongoing website updates via text message
• Website hosting on your custom domain or a subdomain
• Consultation and development services

2. Pricing and Payment

For Marco SMS service:

• Monthly subscription: $9.99/month after free trial
• Free trial: First month free for new customers
• Custom domains: Available as an add-on

Payments are processed securely through Stripe. You may cancel at any time.

Other services are priced separately and will be clearly communicated before engagement.

3. Acceptable Use

You agree not to use our services for:

• Illegal activities or content
• Content that infringes on others' intellectual property
• Harassment, spam, or harmful content
• Adult content without proper age verification
• Activities that could harm our systems or other users

We reserve the right to refuse service or remove content that violates these terms.

4. Your Content

You retain ownership of all content you provide for your website or other services. By using our services, you grant us a license to display and host your content as part of providing our service.

You are responsible for ensuring you have the right to use any content (images, text, etc.) you send us.

5. Service Availability

For Marco SMS service, we strive to respond to update requests within minutes during business hours (9am-9pm PST). Response times may vary outside these hours.

We do not guarantee 100% uptime. Scheduled maintenance and unforeseen issues may occasionally affect service availability.

6. Cancellation and Refunds

• You may cancel at any time by texting "CANCEL" or contacting us
• Cancellation takes effect at the end of your current billing period
• We do not provide prorated refunds for partial months
• Upon cancellation, your website will be taken offline within 7 days
• Custom projects and consulting services have separate cancellation terms

7. Limitation of Liability

Our services are provided "as is" without warranties of any kind. We are not liable for:

• Lost profits or business opportunities
• Data loss (though we maintain regular backups)
• Service interruptions
• Third-party actions or content
• Indirect, incidental, or consequential damages

Our total liability is limited to the amount you paid for the service in the past 12 months.

8. Intellectual Property

Gibson House retains ownership of its proprietary methods, systems, and intellectual property. You may not reproduce, distribute, or create derivative works based on our proprietary systems without written permission.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via SMS or email. Continued use of our services after changes constitutes acceptance of the new terms.
